These Terms of Service ("Terms") govern your use of PainBrief, an iOS application developed by Andrew Patrick (the "Developer", "we", or "us"). By installing or using PainBrief you agree to these Terms. If you do not agree, please do not use the app.
PainBrief is a personal pain tracking tool. It helps you log pain episodes, medications, vitals, and other related information for your own reference and to share with your healthcare providers. PainBrief is provided on an "as-is" basis for personal, non-commercial use.
PainBrief is not a medical device. It does not diagnose, treat, cure, or prevent any disease or condition. Anything the app shows you — charts, summaries, reports, trends — is information you entered (or information from Apple Health), reformatted for your convenience. It is not medical advice. Always consult a qualified healthcare professional about your symptoms. In a medical emergency, call your local emergency services.
PainBrief does not require an account. All data you enter is stored only on your device. You are responsible for any backups (for example, via iCloud Backup of your iPhone). The Developer cannot recover lost data because we never have a copy of it. See our Privacy Policy for full details.
PainBrief offers a one-off in-app purchase, "PainBrief Pro", which unlocks additional features (Trigger Analysis, Time Patterns, Timeline / Journal, and the Clinical PDF Export). The price displayed at the time of purchase applies. Purchases are:

The PainBrief name, logo, app design, and source code are owned by the Developer. You receive a personal, non-transferable, revocable licence to use the app for its intended purpose. All content you enter remains yours.
PainBrief is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free, uninterrupted, or suitable for any particular use.
To the maximum extent permitted by law, the Developer is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app, including (without limitation) loss of data, loss of profits, or any harm resulting from medical decisions made on the basis of information shown by the app.
Nothing in these Terms excludes any guarantee, right, or remedy you may have under the Australian Consumer Law or other mandatory laws of your jurisdiction.
You may stop using PainBrief at any time by uninstalling it. We may discontinue the app or any of its features at any time. If we discontinue the app, your existing local data remains on your device.
We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above and, where practical, announced in-app. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Queensland, Australia. Disputes will be subject to the jurisdiction of the courts of Queensland, Australia, except where mandatory consumer protection laws of your jurisdiction provide otherwise.
